No Pre-Meeting Workshop. The City Commission will be attending three ribbon cuttings on September 5, 2023 prior to the City Commission meeting: Jennie Barker Road Signal - 10:45 a.m. at Grace Bible Church, 8th Street Reconstruction - 11:30 a.m. at the corner of Stevens Avenue and 8th Street, and 12:00 p.m. at the new outbound portion of the Garden City Regional Airport Terminal. Administrative staff will be present and the pre-meeting is open to the public.

A.

Secretary Calvin Reed, Kansas Department of Transportation (KDOT), will address the Governing Body with an update of KDOT happenings and important upcoming events of interest to the community and region. 

V.CONSIDERATION OF PETITIONS, MEMORIALS AND REMONSTRANCES
A.

The Governing Body is asked to consider and approve a request from Angelica Castillo Chappel on behalf of the Community Mexican Fiesta Association to allow the Mayor to proclaim the month of September 2023 as Hispanic Heritage Month in Garden City, Kansas. 

B.

The Governing Body is asked to consider and approve a request from Conny Bogaard, Executive Director at Western Kansas Community Foundation, to allow the Mayor to proclaim the week of September 8-17, 2023 as Welcoming Week in Garden City, Kansas.

C.

The Governing Body is asked to consider and approve a request from Vickie Harshbarger on behalf of Mosaic to allow the Mayor to proclaim the week of September 10, 2023 as Direct Support Professionals Recognition Week.

D.

The Governing Body is asked to consider and allow the Mayor to proclaim September 12, 2023, as Diana Sanford Day in Garden City, Kansas.

E.

The Governing Body is asked to consider and approve a request from Garden City Fire Department personnel to waive Code Section 62-15, Unlawful Solicitation, to allow for department personnel to collect donations for the Muscular Dystrophy Association "Fill The Boot" Drive on September 16, 2023 from 9:00 a.m. to 3:00 p.m.

VI.REPORT OF THE CITY MANAGER
A.

The City of Garden City would like to recognize the Garden City Water Department staff for receiving the Kansas Section American Waterworks Association (KsAWWA) 2023 Safety Award for a Kansas water utility with 10-100 employees.

B.

Congratulations to Water Resource Manager Fred Jones on the occasion of his receiving the KS AWWA Richard Porter Service Award!

C.

Chris Talmage, Ljay Geist and Aiden Miller of the Garden City Fire Department will provide a report of their recent Wildland Team deployment to Alaska.

D.

Assistant City Manager Burke will provide an update on the second round of Moderate Income Housing (MIH) awards for 2023. 

E.

The City has received correspondence from Cox Communications regarding channel line-up changes.

F.

Presentation of the July 2023 report from the Garden City Regional Airport. 

G.

Presentation of the July 2023 Master Activity Report from the Garden City Police Department.

A.

1:30 p.m. - Public Hearing on the matter of the Governing Body hearing questions, concerns and comments from the public with regard to the levy of a property tax rate exceeding the revenue neutral rate and the approval of the 2024 budget. Following the public hearing the Governing Body is asked to consider and approve a resolution to levy a property tax rate exceeding the revenue neutral rate. 

 

  1. Resolution No.____-2023, a resolution of the City of Garden City, Kansas to levy a property tax rate exceeding the revenue neutral rate.
B.

The Governing Body is asked to consider and approve an ordinance to annex real property located on Old Post Road.

 

  1.  Ordinance No. __________ -2023, an ordinance annexing land to the City of Garden City, Kansas that adjoins and is owned by the City of Garden City, Kansas. 
C.

The Governing Body is asked to consider and approve an ordinance rezoning from "I-1" Light Industrial District to "C-2" General Commercial District for the property generally located at 105 N. 12th Street. 

 

  1. Ordinance No. ______ -2023 an ordinance approving the rezoning of certain land in the City of Garden City, Kansas from "I-1" Light Industrial District to "C-2" General Commercial District; amending the zoning ordinance, zoning regulations, and district zoning map of the City of Garden City, Kansas; and repealing the current zoning ordinance, zoning regulations, and district zoning map of the same; all to the code of ordinances of the City of Garden City, Kansas.
D.

The Governing Body is asked to consider and approve an Environmental Nuisance Resolution.

 

  1. Resolution No. _______-2023, a resolution authorizing the removal of nuisance conditions from the property listed below in the City pursuant to Section 38-139 of the Code of Ordinances of the City of Garden City, Kansas (1610 Hattie Street - Branches scattered throughout the property).

The Governing Body is asked to consider and approve an ordinance amending the Code Sections 45-475 and 78-15 to the Code of Ordinances of the City of Garden City.

 

  1. Ordinance No. ______ - 2023, an ordinance regulating the use of rights-of-way for parklets and establishing a fee for the permitting of such use within the corporate limits of the City of Garden City, Kansas; amending current code sections 42-475 and 78-15; repealing current code sections 42-475 and 78-15; all to the Code of Ordinances of the City of Garden City, Kansas.

XI.NEW BUSINESS
A.

The Governing Body is asked to consider and approve the authorization of the 2024 Budget Certificate, which summarizes the maximum levy of property tax for specific funds and the maximum expenditure for all funds of the City's budget.

B.

The Governing Body is asked to consider and approve a request for annexation of the west portion of Jennie Barker Road north of K-156 into the City of Garden City, Kansas. 

C.

The Governing Body is asked to consider and approve a waiver of the Code of Ordinances, Section 78-4(b) regarding awnings at 615 N. Main Street Unit B.

D.

The Governing Body is asked to consider and approve the distribution of the additional round of $250,000 of AFAC funds as recommended by the LiveWell Finney County Board.

E.

The Governing Body is asked to consider and approve an Infrastructure Improvement Agreement and Consent to Annexation for Country Acres Addition - Phase 1.

F.

The Governing Body is asked to consider and approve the CCLIP - GI: K156, 3rd/4th St East to Belmont Place agreement with the Kansas Department of Transportation (KDOT) for $414,000.00.

G.

The Governing Body is asked to consider and approve a $25,000 funding request from the Kansas Health Science Center.

H.

The Governing Body is asked to consider and approve an appointment to the Public Safety Advisory Board.

I.

The Governing Body is asked to consider and approve the appointment of Tanya Ibarra to the City of Garden City Parks and Recreation Advisory Board.

The Governing Body is asked to consider and approve the Replat, 8th Street Brickworks.

2.

The Governing Body is asked to consider and approve an engineering contract with Wilson & Company for the Multi-jurisdictional Safe Streets and Roads for All (SS4A) project for $1,690,000.00.

3.

The Governing Body is asked to consider and approve a contract between the City and Pinegar, Smith & Associates, Inc. for governmental affairs and legislative monitoring services for 2024.

4.

The Governing Body is asked to consider and approve the contractor licenses for September 05, 2023.
