The Governing Body is asked to consider and approve a request from Garden City Fire Department personnel to waive Code Section 62-15, Unlawful Solicitation, to allow for department personnel to collect donations for the Muscular Dystrophy Association "Fill The Boot" Drive on September 16, 2023 from 9:00 a.m. to 3:00 p.m.

Once again, the Garden City Fire Department would like to participate in the fundraising efforts for the Muscular Dystrophy Association with the "Fill The Boot" drive. This has historically been a very successful community event dating back to the 1970's and one of the many ways the department involves itself in the community. This year's event will be held Saturday, September 16, 2023 from 9:00 a.m. to 3:00 p.m.

Firefighters will accept donations at the following locations: Kansas Avenue & Fleming Street, Wal-Mart Super Store, Schulman Crossing shopping center, and Fall Fest Event in downtown Garden City.

Waiver of Code section 62-15, Unlawful Solicitation, is also required as Garden City Fire Department employees will be soliciting donations in the City road right-of-way and entering public streets. Code section 62-15 prohibits solicitations which results in individuals entering a public street that results in interference with the orderly flow of traffic. The waiver of Code section 62-15 is what is being requested of the City Commission at this meeting.

1. The Governing Body may approve to waive Code section 62-15, Unlawful Solicitation, for Garden City Fire Department personnel at the the intersection of Kansas Avenue and Fleming Street, Fall Fest event in downtown Garden City, Wal-Mart Superstore, and Schulman Crossing shopping center.
2. The Governing Body may deny the request for waiver.

Staff recommends approval of the waiver to Code Section 62-15, Unlawful Solicitation.
